Terms and Conditions

At Innovative Mojo, we bring more than 20 years of experience to the table—but we believe that the cornerstone of our success lies in real conversations, with real people, tackling real challenges.
1. Introduction
This document governs the relationship between the Client and InnovativeMojo (The Company).
2. Scope of Work
The specific services to be provided will be outlined in each individual client contract.
3. Ownership
All funnels, graphics, and builds created during the project will remain the property of the Client.
4. Portfolio Use
The Company retains the right to use any created funnels, graphics, and builds in its portfolio, marketing materials, and case studies unless a Non-Disclosure Agreement (NDA) has been signed by the Client that explicitly restricts this use.
5. User Consent for Communications (TCPA & AI Disclosure)
By submitting your contact information to Innovative Mojo, you expressly consent to receive communications from us, including via email, text message (SMS/MMS), and telephone calls.
Nature of Communications: You acknowledge that these communications may be initiated using an automatic telephone dialing system (ATDS) or artificial/prerecorded voice technology (including AI-driven voice agents).
AI Disclosure: You acknowledge that you may be interacting with an Artificial Intelligence (AI) agent for customer service, sales, or support purposes. The AI agent may record and transcribe conversations for quality assurance and training.
Opt-Out: You may revoke your consent to receive marketing calls or texts at any time by:
Texting "STOP" or "UNSUBSCRIBE" in response to any SMS.
Requesting to be placed on our "Do Not Call" list during a call.

6. AI Accuracy & Liability
Artificial Intelligence & Output Accuracy
No Warranty of Accuracy: Our services utilize Artificial Intelligence ("AI") to generate responses, facilitate conversations, and automate processes. While we strive for accuracy, AI technology is experimental and may produce "hallucinations," errors, or inaccurate information. You agree that Innovative Mojo is not responsible for any inaccuracies, errors, or offensive content generated by the AI.
No Binding Offers: Any pricing, dates, or promises made by an AI agent (voice or chat) are subject to verification by a human representative of Innovative Mojo. The AI agent does not have the authority to bind Innovative Mojo to contracts or legally binding agreements without written confirmation.
Human Review: You agree to evaluate and verify any AI-generated output before relying on it for business, legal, or financial decisions.
7. Data Usage & AI Training
By using our services, you grant Innovative Mojo a worldwide, non-exclusive, royalty-free license to use anonymized data and conversation logs (text and voice) to improve our algorithms, train our AI models, and enhance user experience. We will not share your personally identifiable information (PII) with third parties for their independent marketing purposes without your consent.
8. Call Recording & Monitoring
You acknowledge and agree that calls between you and Innovative Mojo (including our AI agents) may be monitored and recorded for quality assurance, training, and compliance purposes. Your continued participation in a call constitutes consent to such recording.
9. Payments
Terms around deposits, payment plans, and cancellations will be specified in the individual client contract.
10. Limitation of Liability
To the fullest extent permitted by law, Innovative Mojo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of your use of our AI agents or website. Our total liability for any claim shall not exceed the amount you paid to us in the last 12 months.
11. Termination & Dispute Resolution
Termination: Either party may terminate the contract under conditions outlined in the individual client contract.
Dispute Resolution: Any disputes arising out of this agreement shall be resolved through mutual discussion, failing which legal avenues may be explored.
Legal Jurisdiction: This agreement shall be governed by the laws of the State of California.
12. SMS Communication Consent
By providing your mobile number, you consent to receive recurring automated marketing and informational text messages from Innovative Mojo. These may include appointment reminders, service updates, offers, and promotional messages. Consent to receive these messages is not a condition of purchase.
You can cancel the SMS service at any time. Simply text "STOP" to any message you receive from us. Upon sending "STOP" we will confirm your unsubscribe status via SMS. After confirmation, you will no longer receive SMS messages from Innovative Mojo. To rejoin, simply sign up again through our website or other available methods.
If you experience issues with the messaging program, reply with the keyword "HELP" for assistance, or contact us directly at support@innovativemojo.com.
